2. Sponsor: The sponsor of this sweepstakes is The Mitchell Gold Co., d/b/a Mitchell Gold + Bob Williams (“Sponsor”). Sponsor’s principal office and mailing address is 135 One Comfortable Place, Taylorsville, NC, 28681. Certain licensed dealers of Mitchell Gold + Bob Williams products may advertise this sweepstakes in their stores, but these actions shall not make any entity other than Sponsor a sponsor of this sweepstakes.
3. Eligibility: Open only to residents of the United States and the District of Columbia, who are as of the date of entry at least 18 years of age, have access to the Internet, and have not purchased internet service in order to participate in this Sweepstakes. Employees, shareholders and agents of Sponsor and their immediate family members and persons residing in the same household as any such person are not eligible to enter or win this Sweepstakes.
4. Entry: To enter, complete and submit your online entry form at www.mgandbw.com (the “Web Site”). This sweepstakes starts at 12:00 a.m. E.S.T. on August 8, 2008 and ends at 11:59 p.m. E.S.T. on December 31, 2008. Limit one entry per person. No more than five entries per household. In the event of a dispute over the identity of an entrant, the winner will be the Authorized Account Holder of the email address submitted on the online entry form. “Authorized Account Holder” means the natural person who is assigned to an email address by the entity or individual responsible for assigning email addresses for the domain associated with the submitted email address. No automatic, programmed, robotic or similar means of entry are permitted. Each entry constitutes express permission by the entrant for Mitchell Gold + Bob Williams to contact the entrant by email.
5. Drawing / Odds: Sponsor will select 1 winner from all eligible entries in a random drawing on January 2, 2009. The odds of winning will depend on the number of entries received. Entrants need not be present to win. Sponsor will notify winner by email. Winner must respond to notification within five (5) days of notification or the prize will be forfeited and a new winner selected in a random drawing. Winner may be required to sign an Affidavit of Eligibility and Release and submit the same to Sponsor within ten (10) days of receiving notification of win. If the prize notification is returned undelivered, the prize will be forfeited and a new winner selected.
6. Prize / Odds: The total prizes awarded will consist of one gift card in the amount of $10,000.00 redeemable at any Mitchell Gold + Bob Williams Signature Store for any Mitchell Gold + Bob Williams product sold by the Signature Store at the time of redemption, subject to availability. Sponsor reserves the right to refuse to redeem the gift card for any item that is unavailable at the time of redemption, in the sole discretion of Sponsor. Sponsor makes no representations regarding the availability of any particular item at any time. The approximate retail value of the total prizes awarded is $10,000.00. All taxes or expenses, including, without limitation, sales tax and delivery charges, and any other costs incurred in claiming or using the prize are the sole responsibility of winner. The prize is non-transferable. The gift card will be redeemable at the then current prices of Sponsor and Sponsor reserves the right to change its prices at any time up to the winner’s redemption. The prize gift card must be redeemed within twenty-four months of receipt. After twenty-four months, the prize gift card will be null and void.
7. Law: This Sweepstakes is subject to applicable federal, state and local laws and regulations. By participating, entrants release Sponsor, its affiliates, shareholders, officers, employees, agents, and consultants from any and all liability for loss, tax liability, or damages of any kind arising from entrant’s participation in this sweepstakes or from the acceptance or use of any prize. Acceptance of any prize shall constitute and signify the winner’s agreement and consent that Sponsor may use his/her name, prize information, and/or likeness for promotional purposes in any media now existing or hereafter devised without any compensation, where legal. This sweepstakes will be governed by and interpreted under the laws of the State of North Carolina without application of any conflicts of laws or choice of laws provisions. Disputes between any winner or entrant and Sponsor related to this sweepstakes shall be submitted to final, binding arbitration heard by a single arbitrator in accordance with the then-current Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in English, in Alexander or Catawba County, North Carolina, and all entrants specifically consent to these venues.
8. Administration: Sponsor reserves the right to cancel, terminate, modify, or suspend this sweepstakes in the event that the sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the sweepstakes.
9. WARNING: Failure to comply with these rules will result in disqualification from this sweepstakes. Sponsor reserves the right to disqualify any entrant whom Sponsor reasonably suspects has tampered with the entry process, undermined in any way the legitimate operation of this sweepstakes, or violated any of these rules. If Sponsor discovers at any time that an entrant has tampered with the entry process, undermined in any way the legitimate operation of this sweepstakes, or failed to comply with any of these rules, Sponsor shall be entitled to recover and seek all remedies and damages, including attorneys’ fees, from such person to the fullest extent of the law, including seeking criminal prosecution.
